Zoning Committee News
 
The zoning committee has been busy attending township zoning board hearings and obtaining updated information on previous applicant requests.

Status updates of some current cases:

Brecknock Township
 
The Zoning Hearing Board will hold a meeting on May 20, 2008 at 7:00 PM in the Brecknock Twp Municipal Building, 1026 Dry Tavern Road, Fivepointville, PA to consider the following application:

The application of Leanne Boerstler, applicant(s) / owner(s), for a special exception pursuant to Section 110-101(d) of the zoning ordinance, for the purpose of operating a dog breeding kennel for Chihuahuas. The property is located at 456 Yellow Hill Road, Narvon, PA, in the Forest Recreation (FR) District of Brecknock Township, Lancaster County.

Salisbury Township
 
The Zoning Hearing Board will meet in the Township Municipal Building, 5581 Old Phila. Pike, Gap PA, on May 27, 2008 at 7:00 PM. Among the items on the agenda is the application of Jacob S. Riehl of 831 Churchtown Rd, Narvon PA for a special exception under Chapter 27 of the Salisbury Township Code of Ordinances, Part 2, Section 201.3.E to operate a kennel to raise dog subject to Section 444. The property is located within the Agricultural District.
Brecknock Township
 
The request by J. Aaron Hoover for a kennel exception was approved amid concerns by the board. He will be required to abide by K-1 kennel conditions.
Salisbury Township
 
No decision was made on the request of Emanual Stoltzfus. The board will give their decision in writing ASAP. No mention that they will give decision at next meeting, Tues., 4/22/08.

If the township approves the request, it should include the following conditions:

  • Must obtain a kennel license from PA Dog Law and show proof before approval.
  • Maintain records according to PA Dog Law.
  • Allow township to insepct whenever needed.
  • Follow all PA Dog Law rules.
  • Must notify township of any PA Dog Law violations within 30 days.
  • Must show proof that any violations have been rectified within 30 days.
  • Maximum of 50 dogs in one year.
Earl Township
 
The application of Matthew M. Martin for an exception was unanimously rejected by the Zoning Hearing Board. Applicant did not adhere to zoning ordinances regarding:
  • No plans for waste disposal
  • Dogs could run freely in yard during the day and night time
  • Parking facilities not discussed
  • More detailed noise control plan needed
East Cocalico Township
 
A hearing will be held on Wednesday, Feb. 13, 2008 at the E. Cocalico Twp Municipal Building, 100 Holl Rd, Denver, PA, to consider the application of Paul B. Zimmerman and Kendra M. Zimmerman for an exception pursuant to Section 220.103 of the Code of Ordinances. Applicants want to house more than 5 dogs in their kennel. The property is located at 31 Garden Spot Rd., Ephrata. The property is zoned agricultural and is owned by Paul B. and Lena Zimmerman.
Rapho Township
 
The application by Melvin K. Lapp was approved with conditions.
West Hempfield Township
 
The application by Elvin High has been withdrawn. He is allowed to keep three dogs and has been granted a specific time period to give up the others.
East Earl Township
 
The application by Marvin Newswanger Jr. was accepted by township officials under conditions, including:
  • Complete and abide by all the applications and permits
  • All state paperwork is to be copied to the township
  • Applicant shall comply with any and all township, state, local and relevant federal laws
